1. Scope of Services

w. provides automated effluent monitoring systems, data collection platforms, and compliance reporting tools designed to assist operators in meeting obligations under the Wastewater Systems Effluent Regulations (WSER). Services are delivered as configured per facility and do not constitute legal advice or guarantee regulatory approval.

2. User Responsibilities

Clients must maintain accurate facility data, ensure sensor calibration per manufacturer specifications, and provide timely access to system components for maintenance. Any modification to monitoring equipment or reporting parameters must be communicated in writing prior to implementation.

3. Data Accuracy and Integrity

w. employs automated validation routines to flag anomalous readings, but final responsibility for data accuracy rests with the client. Reported values are derived from client-provided sensor inputs and facility configuration. w. is not liable for errors introduced by third-party hardware or network interruptions.

4. Limitation of Liability

To the maximum extent permitted by applicable law, w. disclaims all liability for indirect, incidental, or consequential damages arising from service use, including but not limited to regulatory penalties, production downtime, or data loss. Total liability shall not exceed the fees paid for the specific service during the twelve months preceding the claim.

5. Termination and Suspension

Either party may terminate the service agreement with thirty days written notice. w. reserves the right to suspend access immediately if client operations pose a risk to system integrity or violate applicable environmental regulations. Upon termination, client data will be exported and retained for ninety days.

6. Modification of Terms

w. may update these terms with thirty days advance notice via email or in-platform notification. Continued use after the effective date constitutes acceptance of the revised terms. Clients who object may terminate the agreement without penalty during the notice period.

7. Governing Law and Dispute Resolution

These terms are governed by the laws of the province in which the client facility is located. Disputes shall first be submitted to mediation before a mutually agreed neutral party. If mediation fails, the dispute shall be resolved by binding arbitration in accordance with the Arbitration Act.
